Guidance for Settlement and completing formalities for all new greencard holders, landing in USA, an awareness article in public interest by OM International, a leading VISA consultant in Gujarat

Welcome to the United States

A guide for New Immigrants  :

Give Your New Address to USCIS

You must notify USCIS if you change your address. File Form AR-11, Change of Address, within 10 days of your relocation. For information on filing a change of address, go to the USCIS website at www.uscis.gov/addresschange or call Customer Service at 1-800-375-5283. You must notify USCIS each time you change your address.
For more information, call USCIS at 1-800-375-5283 or visit www.uscis.gov.

If You Are a Conditional Permanent Resident

You may be in the United States as a conditional permanent resident (CR). You are a CR if you were married for less than two years to your U.S. citizen or permanent resident spouse on the day your permanent resident status was granted. If you have children, they also may be CRs. See  Form I-751, Petition to Remove the Condition on Residence, for instruction on the filing process for children. Some immigration investors are also CRs. A CR has the same rights and responsibilities as a permanent resident. The conditional permanent resident must file Form I-751, and immigration investors must file Form I-829, Petition by Entrepreneur to Remove conditions, within two years of the date they were granted conditional permanent resident status. This date is usually the expiration date of your Permanent Resident Card. You should file these forms within the 90 days period prior to the two-year anniversary of when you got your conditional permanent residence. If you do not do this you could lose your immigration status.

Filing Form I-751 with Your Husband or Wife

If you are a CR and you immigrated based on your marriage to a U.S. citizen or permanent resident, then you and your spouse must file Form I-751 together so that you can remove the conditions on your permanent resident status. Sometimes, you do not have to file Form I-751 with your husband or wife. If you are no longer married to your spouse or if your spouse abused you, you can file Form I-751 by yourself. You can also file Form I-751 by yourself if deportation from the United States would result in extreme hardship. If you are not applying with your spouse, you can file Form I-751 at any time after you become a CR.

Filing USCIS Form I-751 AND I-829

Who: Conditional permanent resident (CR)

Why: Conditional permanent resident status expires two years after the date you become a CR.

When: Conditional permanent resident filing together with his or her spouse must file Form I-751. Immigrants investors must file Form  I-829. Both of these forms must be filed within the 90 days before conditional permanent residence status expires. The expiration date is on your Permanent Resident Card.

Where to get the form: You can get the form at www.uscis.gov or by calling the USCIS Forms Line at 1-800-870-3676.

Where to send the form: Send it to a USCIS service centre. The address of the service centres is in the instructions for the form.

What it costs: You must pay a fee to file Form I-751 or Form I-829. Before you submit the form, check for the most current USCIS filing fees at www.uscis.gov/fees.

If you file Form I-751 or I-829 on time, USCIS will usually send you a notice extending your CR status for up to 12 months. During this time USCIS will review your application.

If You Are a Victim of Domestic Abuse

If you are a victim of domestic abuse, you can find help through the National Domestic Violence Hotline at 1-800-799-7233 or 1-800-787-3224 ( for hearing impaired ). Help is available in Spanish and other languages.
The Violence Against Women Act allows abused spouses and children of U.S. citizens and permanent residents to self-petition, or file their own petition, to become a permanent resident. See www.uscis.gov or call the National Domestic Violence Hotline for more information.

TIP

Keep several copies of all forms you send to USCIS and other government offices. Send copies, not originals. Sometimes forms get lost, so keeping copies can help avoid problems.

Finding Legal Assistance

If you need help with an immigration issue, you can use the services of a licensed immigration lawyer. You can check with your local bar association for help finding a qualified lawyer. Some states certify specialist in immigration law. These attorneys have passed tests to prove that they have special knowledge about immigration law. The following states currently list certified specialist on their states bar websites: California, Florida, North Carolina, and Texas. Note: You are responsible for determining whether to hire an attorney. USCIS does not endorse or recommend any particular attorney.

If you need legal help on an immigration issue but do not have enough money to hire a lawyer, there are some low-cost or free assistance option. Consider asking for assistance from one of the following places:

    - A Recognized Organization: Organization that is recognized by the Board of Immigration Appeals(BIA). For an organization to be recognized, it must have enough knowledge and experience to provide services to immigrants. A recognized organization can charge or accept only very small fees for those services. For a list of these BIA-recognized organizations,  visit www.justice.gov/eoir/recognition-accreditation-roster-reports.

    - An Accredited Representative: people who are connected to the BIA-recognized organization. These representatives can charge or accept only very small fees for their services. For a list of these BIA-accredited representatives, visit www.justice.gov/eoir/recognition-accreditation-roaster-reports.

    - A Qualified Representative: People who will provide free service. This representation must know about immigration law and the rules of practice in court.
Law school student and graduates, and people with good moral character who have a personal or professional affiliation with you ( relative, neighbour, clergy, co-worker, or friend) are all examples of qualified representatives.

    - Free Legal Service providers: The Department of justice has a list of recognized free legal service providers for people who are in an immigration proceeding. This is a list of attorneys and organizations that may be willing to represent immigrants in proceedings before immigration courts. The attorneys and organizations on this list have agreed to help immigrants pro bono ( free of charges) only in immigration proceedings. Some of them may not be able to help you with non-court-related matters, such as visa petitions, naturalization, etc. The list is available at www.justice.gov/eoir/free-legal-services-providers.

    - Pro Bono Program: Local lists of recognized pro bono organizations and their representatives are usually available at each local USCIS office.

For more information about finding legal services, please visit www.uscis.gov/legaladvice.

Beware of Immigration Fraud

Many immigration practitioners are well qualified and honest, and they can provide good services to immigrants, however, there are some people who take advantage of immigrants.

Beware Friends !!! The Australian High Commission is cautioning the public of a new visa scam allegedly perpetrated by an employment agency running in south-west Delhi; OM International brings this to your notice in public interest.

Australian High Commission Warns of Visa Scam

The Australian High Commission is cautioning the public of a new visa scam allegedly perpetrated by an employment agency running in south-west Delhi. In recent weeks, more than 50 people have reached the High Commission after paying lakhs for a work visa, only to be informed that they have become a victim of yet another visa scam.
The Australian  High Commission is concerned about the growing number of victims and advises any potential visa applicants to exercise vigilance when visa agencies offer jobs.
"Australia does not have a work visa program of the sort being promoted by the scammer- our Temporary Skills Shortage work visa is run only with allowed sponsors, and only for applicants with specific skills in demand in Australia," explained a spokesperson from the Australian High Commission.
"Some of the recent victims have said they paid up to 50,000 INR just for a non-existent airfare and a medical check with an unauthorized clinic, in addition to all the other fees they have been charged."
In addition to being charged for job placement- sometimes with bogus job offers using the names of genuine, well-known companies in Australia -and "visa lodgement " fees, the victims have also had to pay to go through a medical examination in a medical facility also located in South Delhi, that is not associated with Australia's approved panel physician.
The South West Delhi agency has also provided victims with a fake visa grant notice, which links to a non-genuine visa checking service on a fake website.
"we have seen clones of our website before but the newest version link to a fake visa checking site that only contains the visa details concocted by the agent. This may look convincing to someone who is wanting proof the agent is not duping them-but actually, it is still all fake.'
Some of the victims of this fraud have advised that they are in the process of seeking assistance from local law enforcement agencies.
"We work with website hosts to take down the fake website but the scammers often start up again with a different site. we encourage victims of this and another scam to promptly report this illegal activity to local authorities."
All potential visa applicants should refer directly to information published on the official Home Affairs website:www.homeaffairs.gov.au. A list of approved physicians can be found at https://www.homeaffairs.gov.au/about/contact/offices-locations/india. The Australia High Commission website also has a page listing recent scams: http://india.highcommission.gov.au/ndli/visas_and_Migration.html.

Beware Friends !!! Student Visa for Poland

Students from European Union countries do not need a visa to study in Poland. Students from outside the European Union need to apply for a student visa before entering Poland. Contact a Polish consulate or embassy in your country for complete details of the application procedure.

All students have to legalize their stay in Poland by applying for a temporary residence permit. This has to be done a short time after arrival in Poland. The Universities will help you within the application procedures. A temporary residence permit entitles you to stay and work in Poland.

Interested in education in Poland

If you are looking for a high quality European education for a good price you should look to study in Poland. The cost of living together with the tuition fees is lower than in many other European countries whilst the quality of the education system is equally high with over 400 public and private higher education institutions throughout the country.

The Education System in Poland

A large part of the Polish higher education market is made up of private colleges and universities. There are about 310 privately owned universities and colleges and 138 state schools of higher learning. This has resulted in a high level of competition that has given Poland lower prices for studying than in many other European countries. The higher education system is one of high quality and all leading universities offer programmes thought in English, within study areas such as medicine, engineering, humanities, business and finance. More than 100 higher education institution in Poland currently offer study programmes in English. Poland has taken active part in the Bologna Process. The ECTS (European Credit Transfer System) allows students to be geographically mobile and continue their education in other countries.
There is no central administration for admission. Instead, each institute is responsible for their own admission process. However, each applicant must generally hold a “maturity certificate” to qualify for admission in Poland.

Medical Studies in Poland

In a lot of countries you need high grades to enter an education of medical studies. If you don’t reach up to those criteria of high grades, or if you just want to have an experience of studying abroad, there is another option for you - medical studies in Poland.
The medicine programme is 7,5 years long. You study 6 years in Poland at the university and after that is the pre-registration period as house officer. You can choose to do your pre-registration period as house officer in your native country.
You can choose to do your pre-registration period as house officer in Poland or in your native country. A lot of international students choose to do it in their native country. You are responsible to find your own place for your pre-registration period as house officer.
The Medical Universities in Poland are adapted to the common European program, in keeping with the European admission standards for medical education. Inside Europe that education is going to be valid as if it was from your native country. If your are from a country outside Europe, contact a medical school in your native country and ask how it works.

Student Accommodation and Housing in Poland

The student housing is of course important when you are planning to study abroad. Most of the universities in Poland offer accommodation in their own student housing. As soon as you are accepted by the school you get a room in their student housing. Some of the students choose to have this as their permanent home, but most of the students live here the first time to get used to the country, the school and the student life and then they move to a private apartment. The standard of the student housing vary a lot from university to university but generally a private apartment has higher standard than the student housing. Most of the universities can help you to find a private apartment.

Cost of Living and Tuition Fees in Poland

The cost of living in Poland is relatively low in comparison to many other European countries.
The private universities have more places to offer and therefore more humane admission requirements. The private programmes cost more money than the public universities. At the private programmes you pay a tuition that can vary from university to university but normally it is between 9 000 and 100 000 Euros per year.
As a European Union citizen you have the right to apply to the public programs in Poland which are free. If you apply to those universities you have to compete with the Polish students and the admission requirements are a lot higher, and all the teaching is in Polish.

DO NOT Submit Another Application without knowing the real reason for First Refusal.....CAIPS...! Can help you to know your visa rejection result...!!!

What is CAIPS?

#CAIPS stands for “Computer Assisted Immigration Processing System”. It is a computer system used by all Canadian visa Offices / Consulates to process visa applications.
This system is being superseded by new GCMS system. It has a computerized record of all visa applications including remarks and interviews.
if taken by high commission in past outside Canada. CAIPS / GCMS is for any type of Canada visa applications made outside of Canada.

What is the use of CAIPS?
#CAIPS is where all Canadian government notes are kept about your immigration application. CAIPS includes a wealth of information, including:
- Initial assessment scores
- Missing documentation
- Interview dates
- Visa officer notes and comments
- Concerns or problems with your file
If  not heard from Citizenship and Immigration Canada (CIC) in some time and wish to know the
status of the file, or is scheduled for an interview, may wish to obtain CAIPS notes which will provide insight into the nature of any concerns or problems CIC may have with the application.

Om International would feel grateful to help you solve your visa problems and guide you towards re-application.

-The requirement of CAIPS :
(A) If visa application refused
Is a Canadian visa is refused? then CAIPS notes will help to determine the exact reasons for the refusal. These notes will contain details on the location of your application submission, assessment details, and visa officer’s remarks about your application.
CAIPS notes also contain details on incomplete documents and additional details required to process the visa application.
CAIPS notes will prove to be beneficial while visa re-application. You can order CAIPS for visas such as student visa, super visa, spouse dependent work permit visa and various other Canadian visas.

(B)Trouble in the application process.
If your visa application is taking much time than usual, then you can get CAIPS/GCMS ordered to know the factor influencing the delay in the visa process.
CAIPS/GCMS notes will help with the status of the visa giving you a rough idea of how long it might take to be processed.
Refusals or delays in the visa application are mostly due to imprecise application forms or inadequate documentation.
CAIPS/GCMS notes can help you to determine the reason for delay allowing you to plan your next move.
May order CAIPS/GCMS to find out the delay in various types of Canadian visas such as student visa, super visa, spouse dependent work permit visa, and various other visas.

(C) To inspect the previous application for a better re-application.
If the previous visa application was denied, they can find out the exact reasons for refusal via CAIPS, GCMS or FOSS. Even if the Canada visa application was made 5 to 8 years back, can still re-apply after getting CAIPS, FOSS and GCMS note ordered.
This will help you to know what hindered the process so that you can take care of it while re-applying. Your current application may suffer adversely if the previous information and documents related to your background contradict your current visa application. Once you have these notes along with a copy previously submitted documents,

you can be sure about the information held with the CIC or Consulates and can plan the visa re-application accordingly.
